Divorce: Speedier Separations
From 19th June 2017, divorce proceedings will become inherently quicker. When you get married, the last thing on your mind is separating from your partner. Unfortunately and inevitably many people end up having no choice but to go through the procedure of divorce.
However, when indeed you are getting a divorce, the last thing you want is a lengthy, drawn out procedure, taking months if not years to complete. The government have recognised this, and the process will now become much more efficient, saving potential weeks of delay.
Divorce and its financial consequences have always been linked together. Currently, if a financial application is contested, the whole case would be transferred from a divorce centre to a local court to be heard, ultimately creating a very long delay. Therefore, the courts have decided to separate the administrative functions of the financial proceedings from the divorce proceedings.
This new system will be in place throughout the nation after a successful trial run held in Southampton. The results from the trial showed that up to 2 weeks could be saved by not transferring files between courts. This saves a huge amount of time for the parties involved, the solicitors and even the courts.
The process involves simply having the main proceedings and consent orders reviewed at the specialist divorce centres, with contested financial proceedings being worked on independently at the local hearing centres. Dates of any decree nisi or absolute will be highlighted on the financial proceedings file.
